The founders could not see every potential thing that came.  The Constitution is just as relevant today as it was back when our country was founded.  The reason people are calling for the dismemberment of various parts is because they do not want to operate within its constraints.  The biggest offender is the Federal government.  Unfortunately, too many folks do not realize that with our votes we the people are the ultimate arbiters.  If we want to government out of our lives right now..have one side of the legislature be one party and the other the other..that’s gridlock…and frankly that’s a good thing in today’s time.  Many many of the federal laws that exist are unconstitutional and should be repealed.  This is not an issue for the courts.  Folks need to realize the courts do not have the power to strike down a law.  Any ruling along those lines should be ignored (that has happened before btw…I’ll leave that search up for the reader as self-education).  The electorate also needs to stop depending on the media to tell them what is up and what to believe…we the people need to take it upon ourselves to inform and educate ourselves and vote in whatever government we want.  It’s interesting that many of the folks who are complaining the loudest about government is the ones that elected the modern-day monstrosities that exist at the federal, state, county, and local levels.  If you want the government out of your life stop giving them the power to invade your life.  If you really want the government out of your lives, it’s time to elect folks that will not only reduce the budget…but kill many of the programs that just allow the government to invade your lives.  Folks also think this is going to be a microwave process.  Gov’t always moves slowly, at least until it gains enough power to move unrestrained.  Reversing the things that turned gov’t into the monstrosity it is will also take time.  Do not be fooled by those that say…it’s too hard…or it’s gotten too big.  That’s just folks who either do not care or want to keep siphoning off your paycheck without doing anything on their own doing.  It’s not too late….yet..but the time approaching where it will be too late.

I have been watching this whole impeachment thing with a quiet interest.  I “stole” the first part of my thoughts(because it eloquently stated my initial thoughts on this) and then i added the second part. the first part is italicized followed by my own words in regular font.  I posted this on Facebook RE: another thread that appeared and the responses are personal insults to me.  What’s sad is the insults have absolutely zero impact…like those hurled by elementary and k/Pre-k children.

 

President Trump is using their emotional projection(the squad and the loony left and right) as bait. It’s one of the more brilliant political tactics I’ve ever observed; it’s worthy of an entire chapter by Machiavelli. What he’s doing is accusing himself of things that he knows they are doing. So they demand the very investigations that he wants, thereby forcing the media to extensively cover the very topics it wants to bury. The left is still pissed they couldn’t elect Hillary. Take a look at what is going on…Trump is goading them into impeachment..if/when they do he has already revealed what is going to happen…and that is the crooked dealings of Biden and most likely others in the Ukraine and other places…because once the impeachment reaches the Senate then that body has broad suponea power for a full criminal investigation…except it’s not Trump going to prison as he has done nothing illegal..it is others…the ones screaming the loudest both republicrats and dempopublicans are the ones going to prison…that is why pelosi refuses to hold an actual impeachment vote..this is all kabuki to simply try to smear trump and anyone who supports him..if the squad and the lunatic left and right get their way they will destroy themselves and most of the two party system with it..pelosi is being smart here by NOT holding the vote..however trump is correct that until the vote is held this inquiry is NOT a true impeachment inquiry and he is under no obligation to cooperate.

The very multi-millionaires proposing this know good and damn wlel this will not impact them….otherwise they wouldn’t propose it.  Raising the capital gains will hit the middle class..sell your house?  That’s capital gains..which is what the middle class does more often as they try to stay afloat.  this isn’t a stealth attack on the rich..this is yet another tax on the backs of the middle class..so the elites can keep their class from being invaded by the middle class.

The Saudis want to threaten us with price hikes. I hope they do try it..we can easily make up the difference as we have plenty of reserves…especially with ANWAR now open…but the Brakken oil field is not being touched much either…all we would have to do is cut off all of the exporting of energy we are doing..keep it all in country..and the Saudis will not bother us much at all.

It is a fact that Saudi Arabia has spread its Salafist bull**** through the Middle East and we’ve not only tolerated it we’ve called them “friends.”  Well, with friends that kill 3,000 of your citizens may I ask who the hell is supposed to be our enemy?

If, as it appears, they murdered a journalist because he said things the Crown Prince didn’t like then I suppose said Crown Prince has declared that if you don’t like what someone says you can murder them.  Those aren’t my standards, they are theirs.

Well now, perhaps a bounty is in order, since murder is now considered acceptable to the Saudi Crown.

The King (and his crown princes) must live under his own law or there is no law at all.  If it’s acceptable for Saudi’s Crown Prince to order up murders then it’s also acceptable for others to order up his murder.

Since no nation can call itself civilized if it subscribes to that crap the solution is obvious: They’re not civilized and thus they have no right to expect any sort of trade at all, nor any ability to travel here, nor to own anything in or made by this nation — including our funds, Treasuries and land.

Yes, we should be able to prove it first, of course.  Then again maybe the standard of proof could be similar to that the Saudis employ when it comes to how they view gays.

In fact I think using their standards ought to suit them just fine — right?

The Trump Derangement Syndrome has gotten to the point that anything in the media that comes out I hold off on before I post.  I would say about 90% of the time if it is anti-conservative(not cuckservative), anti-trump it’s bullshit.

The instant this Roy Moore stuff started coming out I was highly suspicious.  Back on November 15th Karl Denniger called this story for what it was..an obvious forgery and therefore a total falsehood.  I have included Karl’s post below to make sure it doesn’t disappear due to his site expiring posts from time to time):

The original tweet from CNN can still be looked at.  We’ll see how long it is before they try to take it down.  (Update: It appears one of Getty’s photographers shot the original photo; it’s been linked in the comments, and I checked it.  It’s pretty-clearly the image CNN used and it was also clearly shot in color as it includes portions of the people holding it in the picture….)

I took the image on the right side of their tweet, brought it into Photoshop and increased the size.

I will swear under oath that I did nothing to tamper with the color or tone and in fact did nothing other than increasing its zoom level to 400% because it would be impossible to tamper with the image at said greatly enhanced zoom level without causing visible artifacts in the background and periphery of the letters.  There is also a gradient in the paper caused by a B&W photo being in part of the area where the signature is, which again will cause visible artifacts if I were to try to tamper with it.  In other words I did this to add irrefutable proof that I did not in any way tamper with the image itself.  I also saved the extract from the tweet as a “PNG” which is lossless from my desktop to yours; no compression so there are no artifacts added in my process either; whatever CNN put forward, that’s what I (and you) have.

Those are clearly different inks for everything after the first name.

Was the original signature Roy or was it Ray?

Whatever it was, someone added “Moore DA”, the date and “Olde Hickory House” in a different ink color.

By the way, the claimant says that Moore knew she had a boyfriend “and offered to give her a ride home” when he assaulted her.  Was the boyfriend’s name RAY?

This must be criminally investigated right ****ing now as attempted federal election tampering.  Jeff Sessions, you claim to be “for the rule of law”, let’s see a search warrant for that yearbook to perform forensic testing of the ink, and if the latter part of the “signature” is not 40 years old indictments must issue right now for everyone involved in this crap or you are a lying, sniveling sack of ****.

A bit of truly independent, critical thinking and this is an obvious forgery..isn’t that a crime?  Where are the handcuffs?  I ask that question because now the accuser has admitted to forgery herself.  Karl Denniger on November 14th voiced suspicions about this as well.  Guess what network broke this “story”?  You guessed it..the fakenews network..CNN.

 

 

I just got the most despicable, libelous publication about a candidate in the upcoming Brunswick City election.  Eric Beasely is being targets with allegations that had been expunged that are now apparently being dug up illegally.  I am not a lawyer but this kind of activity cannot be allowed to go unaddressed.  Eric has not asked for this response but I am going to do so.  Eric addressed all of these allegations on a miner detail already:

Whether you support Eric or not please join me in denouncing this behavior from a failed politician who made threats about this earlier.  The postal permit is from Rockville and is the same permit Ficker used during his failed primary run.  This is despicable behavior by anyone and this should not only be denounced but potentially litigated.  If these records were expunged then they have been illegally accessed and now illegally disclosed.  Somebody or potentially some people should be prosecuted and if called for by the law jailed.  Robin Ricker if this was done by you I hope you are prosecuted for this.

I talked about this a while back.  I had warned that obama is going to come after retirement accounts.  I warned about this back in 2012.  We can trust obama and/or the gov’t right?  Socialized medical care was supposed to save us money right?  How did you like the premium increases?  Nice savings.  As long as obamacare is law it does not matter who the president is the gov’t will continue this push.  We need to not only change the president but both congressional houses as well.  That has gotten more difficult with the gov’t sanctioned invasion that is happening right now.  What’s worse is the fact the many american citizens ACCEPT this as the norm.  Many of these “immigrants” are from countries with despotic or socialist backgrounds so they will be happy to vote for the gov’t they had regardless of what that means for the true citizens of this country.  So get ready for folks to move out of private retirement accounts to government ones because of these new regulations.  Of course those will be properly run right?  Sure thing.

first there is this question about his citizenship:

There’s a clean question on the table regarding dual citizenship for persons born in Canada prior to 1977 (when they changed their law to officially recognize dual nationality.)

Prior to that date, with few exceptions, you could not hold dual nationality with Canada.  In other words the very act of “renouncing” Canadian Citizenship means that Cruz never held US citizenship at birth because his parents had to declare his nationality at the time he was born.

There may be exceptions that were available at the time but the law now is immaterial.

The only material fact is what the law was then, in 1970, in Canada when Cruz was born.

If his parents declared US for him then he had nothing to renounce and he has a document called a Consular Report of Birth Abroad.

This is the legal equivalent of a US Birth Certificate and Cruz either has one from the time of his birth or he does not.  If he does not then he is not a US Citizen as he was never naturalized by his own admission and at birth the nation in which he was born did not recognize dual nationality.

Where is that document Cruz?  Your mother’s birth certificate is immaterial.  What matters is whether you were declared a Canadian or US Citizen at birth and what documentation you have to prove it.

You see, in 1970 there was no “and” option.

Cruz either has that Consular Report of Birth Abroad, which is his legal proof of US Citizenship just as my Birth Certificate is mine, or he doesn’t and he’s not a citizen at all as his parents declared his citizenship as Canadian and the land he were born in prohibited dual nationality at the time.

If he doesn’t have that document, of course, there’s a little problem with the office Senator Cruz holds now, say much less his running for President.

 

So this has not been answered by Cruz.  Why not?  Now Trump has risen the stakes even higher by threatening a lawsuit.  If Cruz doesn’t provide proof of the required documentation then there is no way he is eligible for citizenship at all which means his senate seat should immediately be forcibly vacated as well.  This also puts all votes he did as invalid and the votes would have to be recounted WITHOUT his vote taken into account.

Come on folks.  Does everyone figure that because the Demopublicans got Barry into office under cloudy circumstances now mean the Republicrats can now up the ante and have a potential clear cut case of an ineligible person serving in our highest office is now ok?  What is even more dismaying is i am seeing many “republicans” blindly following their national party into this cesspool.  Aren’t the local party offices supposed to be able to think for themselves?  Ted Cruz can EASILY have Trump shut up on this issue and embarrass him by producing the Consular Report of Birth Abroad.  Let’s go Ted…if you are a US Citizen this should be easy for you to produce.  If you really want to show Trump up and Shut Trump up produce this document immediately.  Otherwise you are not a potential non-citizen like Barry but there’s no way you are one and you are even worse than Barry and the “Republican” party is even worse than the Democrats.  This means both parties are out to destroy this country…and most likely most of the citizens will happily vote these criminals into office.

 

Americans have allowed themselves to be so pussified..yes that’s right..pussified that we will cower in fear.  It turns out the shooter reloaded TWICE! Not from his belt but from a backpack?!?!?  Come on folks if within that amount of time you cannot bring yourself to at least charge this asshat then frankly anyone who got shot and died while allowing this fool to reload deserves what they got.  Call me insensitive but this is the final straw for me in terms of the wimping of the American public.  For all your citizens who voted in people who advocated gun control, who advocated the dumbing down of the education system, who voted for representatives who hate this country….the blood of every massacre victim now and in the future is on your hands.

The shooter reloaded two handguns with ammunition from his backpack during the killings, Downing said. Harper-Mercer was “firing on people who were just lying there,” Downing said.

Further, he didn’t have his magazines immediately at-hand (e.g. in a belt pouch or similar) and got them from his backpack?

What are we talking here — 10 seconds or so for each reload?  The people in the room, who had just witnessed their friends getting shot in the head, sat still for long enough to allow this clownface to reload twice?

It gets better.  What I have long maintained is that these shootings are about control and as soon as challenged by anyone who gets aggressive the shooter tends to kill themselves because control is the entire point.

This is why the shooters go to “Gun Free Zones” to commit their horrific act — they know that law-abiding citizens will not be carrying arms suitable for attempting interruption of their control.  It’s also why the mall shooter who was confronted by an armed citizen retreated into a side hallway and shot himself; he lost controleven though the citizen never got a shot off because there were too many other people in the area he might have hit by accident.

And it’s why this shooter, once wounded, killed himself instead of going down fighting.

He didn’t come to fight, he came to exert “control” and murder defenseless people.

As soon as that paradigm was shattered in this mind he was done.

If we removed that paradigm from his consideration by dropping the so-called “Gun Free Zones” that he read as “Murder Here, You’re In Control”, thereby raising the risk that he would confront others willing and able to offer armed resistance to his plan, the assault probably wouldn’t have happened.

But until such a change takes place (and it only will if you insist that the Second Amendment be enforced as written, America) the fact remains that if you find yourself in such a circumstance your best option is to take any tactical advantage, no matter how fleeting, to attack.  There were two such opportunities here and while there is no guarantee of success it certainly beats lying on the ground while the shooter reloads; not only might you succeed in preventing him from getting that mag into the gun it’s a hell of a lot harder to hit a moving target than one that’s quietly lying on the floor.

Gay marriage is only the beginning. Words do have meaning and do have consequences Mr. President to wit:
This morning, the Supreme Court recognized that the Constitution guarantees marriage equality. In doing so, they have reaffirmed that all Americans are entitled to the equal protection of the law; that all people should be treated equally, regardless of who they are or who they love.

Do not think that this stop with gay marriage but all other kinds of marriage band are going to fall now. I do not believe this was an unintentional act either. I think you were fully cognizant of the ramifications of this ruling.  That second sentence says it all Mr. President.  It will soon be legal to marry anyone or anything you wish and as i warned in a previous post (Obama’s lawyers even said the following during arguments: Religious institutions could be at risk of losing their tax-exempt status due to their beliefs about marriage if the Supreme Court holds that gay couples have a constitutional right to wed, President Obama’s attorney acknowledged to the Supreme Court today. )

So churches I repeat my call.  When are you going to drop your NPO status to at least buy some time before you are TOLD you must officiate gay weddings or loose your tax exempt status?  How many will capitulate to keep that (inset golem) “preciousss” tax break?  The ones that boldly have faith in God and renounce their NPO status and adhere boldly to the Bible are the ones who will flourish….the rest will flounder.

This will put me at odds with some friends I know.  I see it this way.  If a church doesn’t want to perform a same sex ceremony they shouldn’t have to.  They should also not fear reprisals(VERY common right now) from same sex couples either.  A new wave of attacks and persecutions are going to fire up.  My question is are the militant LGBTQ’s also willing to go after the Mulims for whom homosexuality is more violently opposed?  If they are so right where’s the outrage against the Muslims?

I am not sure but I have been following this story.  Considering the current SCOTUS rulings in favor of a horrid gov’t enabling emminent domain(they can take your land for ANY reason AND give it to a private business), and of course Obamacare.  I would not be surprised if the SCOTUS sides with the lgbt folks.  Karl Denninger thinks it might be:

That’s right — they didn’t lose simply because they should have lost, they lost because their true agenda was exposed; their campaign of deception, of “inclusiveness”, was exposed at the Court and the Justices took notice of it.

They’re going to lose on that basis.

Among the points in support of this was a statement from the Justices that the applicants “are not trying to join the institution of marriage; they are trying to change what that institution is.”  

This is not only beyond the remit of the court it is beyond the remit of anyone just as you can’t change a man into a woman by cutting off his penis and crafting breasts and a vagina onto his body; you can make him look like a woman but he is still a man.

I suspect that was enough to doom the case, standing alone.  But it didn’t end there; the Obama Administration attorney, under questioning from the Justices, admitted that they are likely to revoke tax exemptions from colleges and other institutions if they do not “comply” with such a policy.  For example, a Catholic University would be forced to allow same-sex couples to cohabit in on-campus housing, never mind that a gay couple couldn’t get married in a Catholic Church by a Catholic Priest in any event!

In other words such a couple would not attend because they’re Catholic and wish to live in a religious fashion under Catholic dogma as that’s impossible as a matter of Catholic Doctrine for said gay couple; their entire purpose in attending said school would be to destroy the institution by attacking its tax exemption.  Yet despite that obvious and blatant act of bad faith the government will stand with them and come after the institution, effectively allowing them to use the government’s monopoly on the use of force to assist them in an intentional act of destruction taken with malice aforethought rather than inclusiveness.

I don’t believe the Justices will allow that to happen.

But if they do then we the people of America must not allow the Justices and their demonstrated willingness to allow these malevolent, intentional acts of vandalism and worse to stand as valid.

For their part Christian ministers and others of conviction have already thrown down that gauntlet by stating that they will not comply.

The interaction between those two, should it come to it, ought to be well worth observing — from well beyond minimum safe distance.

It’s not the Christians actively acting discriminatory against gays(who’s lifestyle is by definition a choice) but the other way around.  Also Christianity is also a lifestyle(a choice of how to live as well).

No one targeted pro-gay bakeries, but gay activists target Christian bakeries. “Support Gay Marriage” is one Christian bakery was sued for refusing to put that slogan on a cake for an event to support the gay agenda. Yet Christian bakeries that refuse to make pro-homosexual marriage cakes are getting sued left, right, and center. They get fined, they get death threats, and they lose their businesses.

Each one denied us the right to have “Gay Marriage Is Wrong” on a cake and even used deviant insults and obscenities against us. One baker even said all sorts of profanities against Christians and ended the conversation by saying that she will make me a cookie with a large phallus on it.

And how many of those bakeries have been sued, threatened, or prosecuted by State Authorities?  Zero.

Even better — the alleged “pizzeria” that refused to cater a gay wedding….. never did refuse.

They were asked, hypothetically — and in fact said they didn’t care who came in to eat at their restaurant (gay, straight, blue, green, Martian or whatever); it was actively supporting an act their religious beliefs forbid they were opposed to and did not wish to support.

Note that the openly gay bakeries above, numbering 13 in a row that were polled, have not been (1) trashed on social media, (2) threatened with being burned the ground, (3) sued, (4) prosecuted by state authorities or in any other way had the same sanctions they demand be imposed on Christian bakeries — and pizzerias — imposed upon them!

According to Alyssa’s own account on Twitter, she “just walked into their shop [Memories Pizza] and asked how they feel” about Indiana’s new Religious Freedom Restoration Act.

Owner Crystal O’Connor says she’s in favor of it, noting that while anyone can eat in her family restaurant, if the business were asked to cater a gay wedding, they would not do it. So what did that business get for such a response?  They were inundated by knowingly false reviews on Yelp (that’s libel folks) by people who have never been there and in fact a female coach at a high school not too far away tweeted what looks like a threat to commit arson:

So let me see if I get this right.

You can pray at any church you want, as long as it’s not Christian.

You can have any religious beliefs you want, as long as they’re not Christian.

You can live to any religious code you’d like, as long as it’s not Christian.

We are in fact passing laws and enforcing them that act to punish people based on their religious beliefs and the fact that they live their lives to those beliefs, so long as that belief system is Christian.

This comports with the First Amendment and does not in fact exhibit a violation of The Constitution, Federal anti-discrimination law, never mind various laws enjoining threats to violent felonies (arson, for one)….. exactly how?

Does someone mind explaining how this concerted set of activities does not reach both State and Federal Racketeering and extortion statutes and why we who are not part of this pressure group should not boycott all states and corporations that back this sort of crap — starting right now and continuing forevermore until these bigots are prosecuted under the very law they are screaming about and got changed to their liking!

It doesn’t end there either; among other provisions are a rollback in trucking safety regulations that will permit drivers to work 82 hours a week and exempts agricultural refuse from clean-water standards.  Yep, you read that right; Congress is voting to both allow big corporate farms to poison the water and big trucking companies to run you over with drivers that are asleep at the wheel.

Pelosuckonitpeon, for her part, has refused to urge her caucus to vote against the bill en-masse.  

Were she to do so she could kill the bill quite effectively.

But she won’t.  Instead, she will line up with Boehner and take her turn at abusing you under the rubric of “keeping the government open.”  And Obama, for his part, has said he’ll sign it — so he’ll line up with Congress in both poisoning you and then running you over.

To declare that the law will not be enforced on a blanket basis for huge groups of people because the President disagrees with the Congress — which has the absolute right to set immigration policy — is a complete stick in the eye to any premise of The Rule of Law that you might believe remains.

What our government is teaching prospective terrorists is that all they have to do is manage to get two jackasses who are willing to die to commit mass-murder, even if they kind of suck at it (let’s face it, when they blew up those bombs in Boston they did commit their intended deed but an hour earlier and 10x as many people would be dead or missing legs.)

Then they pop a cop trying to rip off a convenience store and toss (non-working; they didn’t explode) bombs out the window while trying to elude the cops.

The payoff for doing this is that an entire city shuts down to literal empty sidewalks and train service is halted along a hundred-mile+ stretch.

Even worse now the authorities are allegedly preventing residents who were away from their homes from returning there!  You are now being forcibly dispossessed of your residence!  Yeah, it’s temporary, but so what — that’s my damned house, not yours!  Get the hell out of my way!

Need I remind people that the entire point of terrorism is to terrorize?  To create economic havoc in a given area through violence, and by doing so advance some social or political goal?

What sort of lesson is the jackass in the Oval Office along with those crap-for-brains idiots in Massachusetts sending to our enemies around the world?

These terrorists deserve to assume room temperature as soon as they point a weapon or arm a bomb with the intent to harm anyone else.  The more people willing and able to do that the better, and the best way to respond to this sort of crap is to deny them the economic damage they seek to inflict.

An on-again, off-again move by the Obama administration to scrap the federal gas tax in favor of a pay-per-mile fee would boost the tab to Americans as high as 250 percent, raising their current tax of 18.4 cents a gallon to as high as 46 cents, according to a new government study.

But without a tax increase, said the Government Accountability Office study, the government’s highway fund is going to go dry. One reason the fund is going broke: President Obama’s push for fuel efficient cars has resulted in better mileage, and fewer stops at the pump.

The GAO study is just the latest review of federal spending that paints a grim picture of the nation’s infrastructure. Just keeping spending at current levels, the GAO said, would require a near doubling of the gas tax to 32 cents a gallon, and that would jump to as high as 46 cents should the federal government add spending to fix crumbling infrastructure and build new roads.

The average driver pays about $96 a year in federal gas taxes, said GAO. Should the administration seek to raise the highway trust fund from $34 billion to the $78 billion needed to fix and maintain roads, that could rise to $248. Translated into a pay-per-mile plan, drivers would face a tax of 2.2 cents per mile compared to the 0.9 cents they pay now. Trucks would pay far more.

“We modeled the average mileage fee rates that would be needed for passenger vehicles and commercial trucks to meet three illustrative Highway Trust Fund revenue targets ranging from about $34 billion to $78.4 billion per year. To meet these targets, a driver of a passenger vehicle with average fuel efficiency would pay from $108 to $248 per year in mileage fees compared to the $96 they currently pay annually in federal gasoline tax,” said GAO.

According to the CNN timeline for the Sandy Hook tragedy, “Police and other first responders arrived on scene about 20 minutes after the first calls.” Twenty minutes. Five minutes is forever when violence is underway, but 20 minutes — a third of an hour — means that the “first responders” arent likely to do much more than clean up the mess.

Unfortunately when we continue our examination that we find that there is evil in the world.  There are those who disrespect other people’s rights.  Some of them may want to kill you.  Everyone who undertakes to murder believes their reason for doing so is justified.  That they may be objectively insane doesn’t change their view of the world.  Their desire to see you die is in direct conflict with your right to live.

In that situation one of you will be victorious, and the other will not.

It is your decision, and only justly your decision, how you resolve this conflict.  You have the right to surrender your life if you so wish, but in doing so you are making a decision that only you, and nobody else, has the authority to make.

President Obama and Mayor Bloomberg demand that you cede this decision to an insane criminal.

They are attempting to demand that you not defend your right to life, although they will not themselves do what they demand of you and cede their decision to any person who is insane and would kill them.

They in fact spend millions of your taxpayer dollars to prevent the very victimization they demand you submit to from happening to them.

There is only one sane response to that demand, and it is for you to insist that these people perform an anatomically-impossible act.

Now let’s put this in the context of your children.

When a child is born it is defenseless, hungry and cold.  The newborn baby is dependent upon its parents for everything, other than oxygen from the air, that it needs to survive.  It is incapable of feeding itself, it is incapable of adjusting its environment and bodily covering to deal with environmental changes such as heat or cold, and it is incapable of disposing of the waste products from bodily processes in a manner that will not make itself and others ill.  That child, during the next 18 years, undergoes growth in both mind and body, to the point where (hopefully) he or she is capable of discharging those responsibilities alone.

But until that time comes, you are that child’s protector.  You are the one ensconced with the responsibility to protect that child’s life.

That child’s right to life is unalienable but as that child’s parent you are the one charged with defending that right.

How dare you refuse to discharge that responsibility!

Mayor Bloomberg and President Obama, along with many others have, thus far successfully, demanded that you intentionally refuse to defend your child’s right to life as soon as that child enters a school — and they then attempt to compel you, by law, to have that child attend some form of school!

How dare you consent in place of that young person who is too young to do so!

They have the gall to tell you that your children must be unarmed targets while armed guards stand at the ready next to them on a literal 24 hour a day basis to prevent the same thing from happening to them, while forcing you to pay for their protection.

How dare you accept this premise while they smugly stand with their Secret Service and Police, armed to the teeth, not even willing to step inside a hotel without security first checking to make sure there has been no evil laid in!

Now I would like it very much if we could find a way to rid the world of evil.  Simply making all guns disappear, which is incidentally a factual impossibility, is unfortunately insufficient.  One of the worst mass-murders committed in the 20th century was undertaken by a man with less than a gallon of gasoline and two matches; he killed 80 people here in the United States and is currently in prison for life.  No gun law in the world could have changed that outcome, for he did not use a gun. Another nutjob blew up a federal building in Oklahoma; he used fertilizer, diesel fuel and a truck.  Likewise people have murdered with cars, SUVs, swimming pools, common household goods used as poisons along with sporting goods, including baseball bats, golf clubs and even their bare hands.  A not-insignificant number of murders in China in recent years have been committed (in schools no less!) by knife-wielding assailants.  Your kitchen contains more than enough implements of destruction to murder virtually anyone, especially if taken by surprise.  Harris and Klebold at Columbine not only used guns, they also attempted to blow up the school with tanks of ordinary propane; fortunately the detonators failed to work.

I don’t see anyone talking about banning outdoor BBQ grills.

Why does the media only cover guns in the face of such tragedy? Why don’t they discuss it when we can examine the subject coolly and rationally, and maybe get somewhere?

Because then we might learn something. Because then the public could become educated, and the media does not really want this to happen. Because then you might learn that guns have social utility, and are indispensable — that guns serve good purposes — instead of being pounded with the hopelessly false idea that arms are bad.

If the media covered guns without tragedy as a background, you would learn that guns save lives, which is why we want our police heavily armed, with high-capacity magazines, and high-powered rifles, and all the ammunition they can carry. You would learn that you need guns and ammo and full-capacity magazines — for the exact same reason.

You would learn that your need is even greater, because YOU are the first responders, and police are always second. You face the criminals first, in every event. Police, with all their deadly bullets only show up later. Police are the second responders. Media stories are always wrong about that. That’s what you say.

Because so-called “news” media gun stories are not news, they are propaganda. Showing the image of a mass murderer 100 times a day isn’t news, it is propaganda. Because staying on the same single event for a week or more isn’t news — even reporters would call it old news, or yesterday’s news, or yellow journalism, if they were being honest — a trait many have long since lost the ability to exercise. It is propaganda by every definition of that term.

Should people who put scores of guns into the hands of drug lords get one-month sentences — like we saw the very day before this massacre — is that right? Why isn’t THAT discussed? How did you let that skate by? Don’t tell me you covered that story, if you simply reported the government handout, that Fast and Furious smugglers Avila and Carillo were sentenced. That’s not reporting, that’s reading.

A few things you won’t hear about from the saturation coverage of the Newtown, Conn., school massacre:

Mass shootings are no more common than they have been in past decades, despite the impression given by the media.

In fact, the high point for mass killings in the U.S. was 1929, according to criminologist Grant Duwe of the Minnesota Department of Corrections.

Incidents of mass murder in the U.S. declined from 42 in the 1990s to 26 in the first decade of this century.

The chances of being killed in a mass shooting are about what they are for being struck by lightning.

Until the Newtown horror, the three worst K–12 school shootings ever had taken place in either Britain or Germany.

Almost all of the public-policy discussion about Newtown has focused on a debate over the need for more gun control. In reality, gun control in a country that already has 200 million privately owned firearms is likely to do little to keep weapons out of the hands of criminals. We would be better off debating two taboo subjects — the laws that make it difficult to control people with mental illness and the growing body of evidence that “gun-free” zones, which ban the carrying of firearms by law-abiding individuals, don’t work.

First, the mental-health issue. A lengthy study by Mother Jones magazine found that at least 38 of the 61 mass shooters in the past three decades “displayed signs of mental health problems prior to the killings.” New York Times columnist David Brooks and Cornell Law School professor William Jacobson have both suggested that the ACLU-inspired laws that make it so difficult to intervene and identify potentially dangerous people should be loosened. “Will we address mental-health and educational-privacy laws, which instill fear of legal liability for reporting potentially violent mentally ill people to law enforcement?” asks Professor Jacobson. “I doubt it.”

Gun-free zones have been the most popular response to previous mass killings. But many law-enforcement officials say they are actually counterproductive. “Guns are already banned in schools. That is why the shootings happen in schools. A school is a ‘helpless-victim zone,’” says Richard Mack, a former Arizona sheriff. “Preventing any adult at a school from having access to a firearm eliminates any chance the killer can be stopped in time to prevent a rampage,” Jim Kouri, the public-information officer of the National Association of Chiefs of Police, told me earlier this year at the time of the Aurora, Colo., Batman-movie shooting. Indeed, there have been many instances — from the high-school shooting by Luke Woodham in Mississippi, to the New Life Church shooting in Colorado Springs, Colo. — where a killer has been stopped after someone got a gun from a parked car or elsewhere and confronted the shooter.

Economists John Lott and William Landes conducted a groundbreaking study in 1999, and found that a common theme of mass shootings is that they occur in places where guns are banned and killers know everyone will be unarmed, such as shopping malls and schools.

Laws don’t stop massacres….read on.

 

But they’re not what people are promoting, especially those who are always looking for a way to shove you in the hole — right after they remove your ability to resist.

And let’s not kid ourselves — that’s exactly what happened in Connecticut.  The teachers and staff in that school had no lawful means to resist, because they accepted (and probably even supported) the fallacious argument that laws (paper) stop bullets.  They learned, too late, that this argument is and always has been false.

A murderous thug, enabled by foolish reliance on pieces of paper, shoved them in the hole.

If you believe that “gun control” (of any sort) will stop these events you’re suffering from a severe case of logical fallacy — or delusion.  The worst mass-murder in a school wasn’t committed by Adam Lanza.  That distinction belongs to former school board treasurer Andrew Kehoe, who got*****ed off about a property tax levy and detonated three bombs in Bath Township, Michigan, killing 38 elementary school children, two teachers, a handful of other adults and himself.  Nearly 60 were injured.

That murderer also killed his wife and set his farm buildings on fire just before he set off the bombs. 

Believe it or not, Bath Township got off light.  There were over 500lbs of additional explosives planted in the buildings that failed to go off; he intended to destroy the entire school and presumably kill everyone inside, but the second device failed to explode.

Nor do you need a gun to commit mass-murder in general.  One of the worst mass-murder events in US history was committed in 1990 with a gallon of gasoline; Julio Gonzalez, who was later convicted of arson and murder, spread gasoline on the entrance to the club and set it ablaze.  87 people died.  Not only did the gasoline cost far less than a gun, it is much easier to obtain.  Do you recall any hue and cry for the banning of gasoline, or even for gasoline-powered weed-eaters and lawn-mowers (or, for that matter, portable generators) — the predicate items that for sane people compel them to buy and use a portable gas can, and thus make portable gas cans available to homicidal maniacs?

Next, let’s talk about the school once again, because here we see an over-reliance on half-measures and “feel good” ideation as well.  The school locked the doors and required a buzzer to enter, which sounds reasonable.  The problem is that they didn’t armor the glass in the immediate vicinity of the door, making possible a trivial forced entry.  A person intent on homicide doesn’t care if he breaks a window (a petty crime) first.  You can’t reasonably replace all windows with shatter-proof panes (e.g. wired-mesh glass that can be shot through but will not break in a fashion that allows entry) but you can do so for that glass in an entry door or in its immediate vicinity, and you can for small windows in and immediately in the vicinity of classroom doors.  You can also equip classroom doors with cylinder deadbolt locks that require a key from the outside to open, but can be operated without a key from the inside.  These enhancements, which are pretty inexpensive, would have thwarted the shooter’s forced entry into the school and if he gained entry to the building would have prevented his entry into the classrooms.  There are reports that teachers had to use file cabinets and their bodies to barricade the doors; one was shot and injured doing so.  That’s outrageous when a quality deadbolt-equipped door and metal frame bolted to the structure of the building costs only a few hundred dollars. 

I want to know who was behind the changes made to “secure” this school and what sort of analytical process was undertaken, whether it was debated in the open at a school board meeting, whether the public was involved, and whether the public was invited to think about and comment on the path undertaken and its expense.  Again, while hindsight is always 20/20 if the fact that a plate window was in the immediate vicinity of a “locked” door was not looked at as a security problem then I question both the people and the process involved in “hardening” this installation.

Next, let’s talk about the adults in the school.  We already require training on sexual assault, child abuse and similar issues for school teachers and administrators.  Why do we omit self-defense from this list, when our teachers and administrators claim the right of in loco parentis during school hours for our children? 

That omission is asinine.

I invite anyone opining on this massacre read this entire article at the link below.  there are some facts in here you will never hear about in the “mass media’ at all.  Read all of the facts here before pining…

 

We’ll start with the guns.  They are reported to have been legally owned by the shooter’s mother and included a Glock pistol, a Sig pistol and a .223 caliber rifle.  The rifle has been reported to be a sporting variety commonly used for target practice or hunting varmints; if the make and model reported are correct it is indeed a hunting variant (it has a fixed stock as hunting rifles typically do, no flash-hider on the front or other “scary looking” but immaterial cosmetics, etc.)  Sig makes extremely high-quality (and commensurately expensive) pistols; Glock of course makes highly-reliable and well-respected weapons as well.  A little-known fact about Glocks is that for many people they “point” funny due to a different grip angle than most other pistols; some people find them very difficult to shoot accurately for this reason.  That may be why the mother owned both (she may have bought one and not liked it, then bought the other.)  The rifle was found inside the car the shooter drove and since he never came out of the school building once going in it must be presumed that he did not use that gun in the school assault.  There is nothing particularly-remarkable about the weapons used in this assault; they are common guns used lawfully by millions of Americans for hunting, target practice and defensive purposes.

Of note is that the shooter could not have legally acquired the pistols, as he is not 21.  Federal law requires one to be 21 years of age before purchasing a pistol at retail.  In this particular case, however, it doesn’t matter whether he was 21 or not as he didn’t buy any of the weapons involved; they were lawfully purchased by his mother who the assailant murdered prior to assaulting the school.

In other words the shooter effectively stole the weapons used in the assault.  We do not know at this point (and may never know) the exact order of events in terms of his acquisition of the weapons but what we do know factually is that he murdered their owner, ending her ability to report the theft or to resist what he intended to do with them next.

That is, there was no “gun control” violation involved in this assault.  The bad guy did not obtain the weapons through lawful means and he also did not (legally or not) circumvent the background check system by, for example, buying them privately from someone (the much-maligned “gun show loophole” that people talk about but is almost-never actually implicated in an assault.)  Rather, the assailant removed the weapons from their lawful owner through, either directly or indirectly, the crime of murder.

As a retired school teacher with no reported criminal history, there was utterly no reason to prevent the mother from owning these firearms for perfectly reasonable and lawful purposes, such as paper-punching or self-defense.  Being divorced — as a single woman — she had every right and reason to be armed for defensive purposes, particularly in her own home.

How many times can Republicans purge those to their right from their ranks and still be meaningfully considered to represent the American political right?

Boehner, Majority Leader Eric Cantor (R-Va.) and Majority Whip Kevin McCarthy (R-Calif.) have worked assiduously to keep conservative groups on the outside in line as they try to strike a massive deal to keep taxes low on all Americans and avoid spending cuts to the Pentagon and other domestic programs. The traditional right — The Wall Street Journal editorial page, National Review, Fox News and business-friendly analysts on CNBC — have been lockstep in line with Boehner, the result of careful outreach by leadership staff. But now, top House leaders suddenly find themselves under fire from entities with enormous sway in GOP politics.

The fact that the WSJ, NR, and Fox are pro-business doesn’t mean they are traditional right.  Not anymore.  Mussolini and Hitler were pro-business too.  The irony is that the right was told that they had to dutifully line up behind Mitt Romney because he was, as a moderate, more electable than the anti-bank, anti-war, Ron Paul.  Then, when Romney went down in flames just like McCain, Bush, Dole, Ford and every other elite-selected moderate before, what passes for Republican “leadership” in the House is trying to keep moving left.

If you are a conservative who is still a Republican, I have a very simple question to ask you: why?  It is becoming increasingly obvious that both conservatives and America would have been better off if the John Birch Society purged William F. Buckley rather than the other way around.

Think long and hard ladies and gentlemen.  Political parties and groups will try to tell you that you must choose between evils, and of course they are the lesser of them, as if there is no other option.  But there are other options — you can refuse to participate entirely or you can go off and form a new group among those of you who refuse to be abused.

The woman in an abusive relationship or the person in a cult may not recognize that they are the victim of abuse but this does not change the objective view of what is going on.  Your time, effort, personal well-being and sometimes wealth are being siphoned off for the benefit of others — and to your detriment.

Today is a day for reflection and to give thanks for that which we have, for many do not.

But it is also a day to reflect on the relationships we have in our lives, whether they be personal, professional or political, and determine which of those are truly complimentary and mutually beneficial and which are, in fact, co-dependent and abusive.

As we move toward the New Year let us all strive to make that determination and to rid ourselves of those relationships that fit in the latter category; we will all individually be better people, and as a society we will find collective benefit through this process as well.

However, since Obama has been in office, conservatives and some Republicans have taken up this fight. In reality, this should be a fight for ALL of us. These are issues of basic human freedoms. The fact that Republicans have ignored the creeping Big Brother statism is just as egregious as the Democrats forgetting about it just because ‘their man’ is in office.Romney has no intention to disentagle us from foreign wars. He’s stated that he would actually be more aggressive in this regard. I won’t rehash this because recently FedUpUSA featured two articles about our folly in the Middle East and how the policies of government are getting our own troops killed. Suffice it to say, Romney states that it will be business as usual in this department. Obama on the other hand, ran on ‘hope and change’ and part of that change was supposed to be, as many liberals and Democrats were demanding, getting the hell out of the Middle East. What he’s done instead has been the complete opposite, and in fact, he’s made at least one unilateral, Executive act of aggression on a foreign power, which entirely bypassed congress. Weren’t liberals foaming at the mouth about George W. Bush doing just this same thing? The Democrats have been deafeningly silent. Democrats are apparently only anti-war when their guy isn’t in office.So, let’s summarize: What we have in Romney is a white Obama, who has built a false belief around himself that he is a pro-business capitalist, despite the fact that he made the majority of his wealth based upon government picking his sector as a ‘winner,’ resulting in it being the recipient of extreme preferential treatment. So, what he IS, is an adept cronyist, not a capitalist. With help from the Republican Party and a desperate ’conservative’ American public, despite the above-listed facts, Republicans and conservatives have now convinced themselves that Mitt Romney is somehow going to represent conservative principles and is somehow going to be better than Obama. More than 1,000 pastors are planning to challenge the IRS next month by deliberately preaching politics ahead of the presidential election despite a federal ban on endorsements from the pulpit.

The defiant move, they hope, will prompt the IRS to enforce a 1954 tax code amendment that prohibits tax-exempt organizations, such as churches, from making political endorsements. Alliance Defending Freedom, which is holding the October summit, said it wants the IRS to press the matter so it can be decided in court. The group believes the law violates the First Amendment by “muzzling” preachers.

“The purpose is to make sure that the pastor — and not the IRS — decides what is said from the pulpit,” Erik Stanley, senior legal counsel for the group, told FoxNews.com. “It is a head-on constitutional challenge.”

Stanley said pastors attending the Oct. 7 “Pulpit Freedom Sunday” will “preach sermons that will talk about the candidates running for office” and then “make a specific recommendation.”

“We’re hoping the IRS will respond by doing what they have threatened,” he said. “We have to wait for it to be applied to a particular church or pastor so that we can challenge it in court. We don’t think it’s going to take long for a judge to strike this down as unconstitutional.”

An amendment was made to the IRS tax code in 1954, stating that tax-exempt organizations are “absolutely prohibited from directly or indirectly participating in, or intervening in, any political campaign on behalf of (or in opposition to) any candidate for elective public office.”

“Violation of this prohibition may result in denial or revocation of tax-exempt status and the imposition of certain excise tax,” the IRS says in its online guide for churches and religious organizations seeking tax exemption.

New York Mayor Michael Bloomberg, a long-time advocate ofgun control, called on both candidates to address what they would do to help prevent such tragedies.

“No matter where you stand on the Second Amendment, no matter where you stand on guns, we have a right to hear from both of them concretely, not just in generalities –specifically what are they going to do about guns?” Bloomberg said today on WOR Radio. The mayor is founder and majority owner of Bloomberg News parent Bloomberg LP.

 

Gun control is why this murderous assailant managed to kill 20 people and nobody had a crack at shooting him, as they were unarmed.

Let’s look at the facts of this event.  Metal detectors and searches would have done nothing to prevent this, but would have treated every patron as a felon.  The assailant came in through a back door, which means he tampered with a crash-bar equipped exit at some previous time or had “help.”  Those exits are necessary for fire safety purposes.

Reports are that the assailant was wearing body armor.  This would have made him much more difficult to shoot and stop for an armed citizen, but body armor is not “bullet proof”; it is bullet resistent, and if you take a round in the chest while wearing it the energy is still dissipated on your chest — it just doesn’t make a hole.  Continuing to shoot people while being punched in the chest (pretty much what the shooter would be experiencing) would be difficult — but not impossible.

The presence of a bunch of openly-carried or concealed weapons might have done nothing.  A pistol against a guy toting a rifle or shotgun is not a “fair fight” but it beats nothing, which is what the victims had.  The option to fight back is better than no option at all, whether you can or do choose to use it or not.  Oh, and let’s not forget that it appears that Cinemark, the company that owns the theater, appears to prohibit by policy law-abiding citizens carrying concealed weapons.  If the assailant knew this (and it is, apparently, posted on signs at the ticket counter of at least some of their theaters) then he knew that every patron in the place was literally a walking target unable to defend him or herself as law-abiding citizens are disarmed by signs — but criminals are not.

I am going to cross post this to both blogs as this affects me both as a person and a business man.

 

Now consider this — the PPACA sets forth a “fine” (tax) of $2,000 per employee for a business that has 50 or more and does not provide “at least” the minimum “insurance” to all.

There is no health care plan I’m aware of that a business can buy today that costs less than $2,000 per employee per year, and which also meets the requirements in the law.  None.  That was almost impossible to meet back in 1995 for a healthy, 18 year old insured single male.  It’s flatly impossible now and it’s doubly-so if your workforce has other than 18-year old single, healthy males in it.  I know this to be factual because I was responsible for buying it for our employees as a CEO of a company.

Therefore the incentive is for all businesses to drop health care. 

Period.

Second, your choice is to either (1) buy and have said plan (whether through employment or individually) or pay a “fine” (tax) of 1% of income (increasing to 2.5% of AGI in 2016.)  The minimum “fine” is $95 starting in 2013, rising to $695 in 2016.  The average family income is about $50,000/year, which means that the fine (tax) will be $1,250 in 2016.  It’s less now.

You cannot buy health insurance at their “minimum level” for anything approaching $1,250 a year no matter how healthy you are at any age. 

The law prohibits insurance companies from charging you more if you’re sick, or refusing to cover you at all.  They must accept everyone on equal terms.

Therefore:

Businesses will drop coverage; it’s cheaper (by far) for them to pay the fine and, for those under 133% of the federal poverty level, those employees can go onto Medicaid.  This is a “family of four” income of $31,900 (as of today; it will go up of course.)  That’s roughly the second quintile.

Individuals will drop coverage and pay the fine, since it’s far cheaper than to buy the “insurance.”

Both will buy the “insurance” only when they get sick, since they cannot be upcharged.

The cost of “insurance” will thus skyrocket to 10x or more what it costs now, just as it would if you bought auto insurance only after you wrecked or homeowners insurance only after you had a fire.

At the higher price nobody will be able to afford to buy the insurance at all, since that will be indistinguishable from just paying for whatever is wrong with you, plus the insurance company markup.

In very short order the entire medical system and health insurance scheme will collapse, leaving only two choices — either a return to free market principles (including all I’ve argued for since this debate began) or a single-payer, fully-socialized system ala Canada.

You can bet the government will continue to try to change the terms of the deal — including ramping up the tax/fine and other games, to prevent this outcome, but they will fail.

Now the question becomes this:

Which Presidential political candidates have told you the above, and what are their answers to this dilemma?

Let’s go down the list.

We know what Obama’s is — he passed it.  You will lose your private health care under Obama.  Period.  We are headed for a fully-socialized medical system and a collapse of the current medical paradigm under Obama.

We know what Gary Johnson’s position is — he wants to “block grant” all Medicare and Medicaid to the states, cut the amount of money in the budget (all line items) 43% and repeal Obamacare (including the mandate.)  But he refuses to demand an end to the cost-shifting where Juanita the illegal Mexican immigrant who is 7-1/2 months pregnant while drug and alcohol dependent shows up in the hospital, in labor, and foists off a $2.5 million NICU and birth expense bill on you!  He also refuses to stop the drug companies from effectively forcing Americans to bear the cost of all drug and device development and he has refused to put a stop to differential billing.  The latter two only exist because of explicit federal laws that make lawful in the health industry market behaviors that are illegal in virtually every other line of work (see The Sherman Act, The Clayton Act, and Robinson-Patman for starters.)  All of these facts are why the costs are ramping in the first place, which means his plan will simply force the States into bankruptcy and continue screwing you at the same time.

We don’t know what Romney’s plan is in detail.  He’s been oddly silent in that regard.  He says “Obamacare is not the answer” but he passed it as Governor on a state basis!  He too advocates nothing to put a stop to the cost-shifting and anti-competitive acts of drug and device makers nor hospitals and other medical providers.  He too wants to block grant Medicaid but that does nothing to address the problem and will simply bankrupt the state budgets (as noted for Johnson.)   Conspicuously absent from Romney’s plan (as is true for Johnson) is (1) a repeal of EMTALA, (2) a demand for level, consistent pricing irrespective of how one pays for a service (3) and a demand to remove anti-competitive laws protecting differential billing across state and national boundaries (e.g. Viagra for $2 in Canada .vs. $20 here) so that Americans are not forced to subsdize everyone else in the world and you pay the same price as the guy next to you in the hospital for the same product or service, instead of 2x, 3x, 5x, or even 100x as much.

So we have three Presidential candidates, none of which will do a damn thing to fix what’s wrong with health care.  All three are promoting a path that will bankrupt the States, bankrupt the Federal Government, bankrupt you or all three.

Many people mistakenly believe one of the roles of government is to protect them from physical harm.   However, this is not the case.  One only has to look up the concept of “affirmative duty” to understand what the Supreme Court has defined as the role of any government entity in regard to protection of citizenry; both at Local/State and Federal levels.  In short it can be encapsulated as:

The burden to defend and or use deadly force, is a right that lies with you personally to act accordingly, and appropriately, should you fear for your life and/or limb.  The government does not have any affirmative duty to do this for you. 

In South v. Maryland, 59 U.S. (How.) 396, 15 L.Ed.433 (1856) – the U.S. Supreme Court ruled that local law-enforcement had no duty to protect individuals, but only a general duty to enforce the laws.  This is a distinction which needs to be clearly understood.

The affirmative duty to protect arises not from the State’s knowledge of the individual’s predicament, or from its expressions of intent to help him, but from the limitations which it has imposed on his freedom to act on his own behalf, through imprisonment, institutionalization, or other similar restraint of personal liberty.

If you are under the care or custody of the ‘state’ then, and only then, do they have a specific duty to protect you from harm.   Or, if the ‘state’ has diminished your capacity to protect yourself, then they “may” arguably be in a position of affirmative duty, but only to the extent the state has diminished your capacity to act on your own behalf.

In all other considerations the “state” only has the duty to enforce the law.

If law enforcement has no affirmative duty to protect the citizenry, which they absolutely do not, and the police have argued numerous times in court to prove they are under no responsibility to protect a person from physical harm, then why should the group without affirmative duty be espousing that an individual remove their legal and constitutional right to protect themselves.?

I’m having fun sitting back watching all the repubs fawn over Romney.  The architect of Romneycare in mass.  Anyone who thinks he’s going to be massively different than Obama is in for a rude awakening.  I’ve been listening to Rush and he’s leading the fawning..it’ll be interesting to hear him try to cover tracks much like the Obamabots are trying to do right now..:)  It’s even more fun due to local folks i know and local pols are also doing fawning…trotting out the same lesser of two evil arguments.  If you vote the lesser of two evils you are still voting for evil.  Blaine Young also tried the “he has business experience” tack when I was able to call in but that doesn’t matter.  Look at his political record..Romneycare.  Obamacare(barring the Supremes doing something unconstitutional…aka..striking down the law) isn’t going anywhere.  If the law gets struck or gutted Romney will be there to replace it with something more onerous.  Romney is going to be Obama without the citizenship fraud and dark skin.

I won’t happen because right now the American people won’t stand up for our nation’s Constitution and laws….but if they would it’s time for this lawbreaker to get removed.  Keep in mind that when you remove Barak his next in line(Biden) won’t be any better.  I can’t for sure about the current speaker but i wouldn’t be surprised if he got removed too.

Legally, President Obama has reiterated the principle that he can pick and choose which U.S. laws he wishes to enforce see his decision to reverse the order of the Chrysler creditors, his decision not to enforce the Defense of Marriage Act, and his administration’s contempt for national-security confidentiality and Senate and House subpoenas to the attorney general. If one individual can decide to exempt nearly a million residents from the law — when he most certainly could not get the law amended or repealed through proper legislative or judicial action — then what can he not do? Obama is turning out to be the most subversive chief executive in terms of eroding U.S. law since Richard Nixon.

Somebody you know you can count on…not only to stand beside you when things are good but to stand beside you when either you screw up or when you are under attack through no fault of your own. I can count the number of friends i have on one hand. Friends are based on trust and frankly the number of people i inherently trust are few…with the recent attacks perpetrated against me and my family nobody gets a one step pass anymore.

Keep in mind folks…the gov’t isn’t here to help you anymore. they are looking to take control of every facet of your life. When Hitler took over want to know one of the first things he did? He nationalized healthcare. Once they can dictate how to keep you healthy they can dictate anything. Guess what we have now? Obamacare…guess who brought the blueprint into action? Romney. Anyone who thinks Romney is going to get rid of Obamacare or stop this country towards heading to a socialized government isn’t in their right mind or doesn’t have the self-thinking abilities needed to keep this country free.

I’ve been trying to be “more civilized” the past few years…it’s gotten me more problems with folks who think they know more than me about many things they have no idea about.  The lid’s off now…:)  I’m going to express how i feel and if folks can’t handle it..too bad for them.  My loving wife likes to tell folks i’m a redneck…that hasn’t shown much…i won’t be vulgar or destructive but the filters are gone now…if i don’t like something..or you..you’ll know…right then.  I’ve had a better life when I’ve remained true to myself….it’s a hard lesson to learn..one I’ve recently been reminded of by a coward recently.  Now i have the Gov’t getting into my affairs.  It’s time for this lunacy to stop…and it’s time to get out of any kid of incorporated “city” entity…Frederick county isn’t rural enough anymore…because of Frederick city.  Their cancer is now spreading into the rest of the county..of course it’s a symptom of the state of Maryland being the way it is.  I’m looking for Kentucky or maybe Tennessee type rural area. Some folks are in for quite the awakening….i’ll leave those details as a “surprise”…watch for the rattlesnake..they tend to bite when tread upon..:)  My previous post with Aaron Lewis has some great lyrics:

This bill will do nothing to folks such as those mentioned in this article. It will only increase the flight from our country and they will all raise the middle finger since they’ll never have to come back to this country nor touch any operations that have any kind of business nexus in it either.  F-U money is what these folks have and they will utilize said Middle Finger power quickly.

Russia’s top military officer has threatened to carry out a pre-emptive strike on U.S.-led NATO missile defense facilities in Eastern Europe if Washington goes ahead with its controversial plan to build a missile shield.

President Dmitry Medvedev said last year that Russia will retaliate militarily if it does not reach an agreement with the United States and NATO on the missile defense system.

Chief of General Staff Nikolai Makarov went even further Thursday. “A decision to use destructive force pre-emptively will be taken if the situation worsens,” he said at an international conference attended by senior U.S. and NATO officials.

Russian Defense Minister Anatoly Serdyukov also warned on Thursday that talks between Moscow and Washington on the topic are “close to a dead end.”

U.S. missile defense plans in Europe have been one of the touchiest subjects in U.S.-Russian relations for years.

Moscow rejects Washington’s claim that the missile defense plan is solely to deal with any Iranian missile threat and has voiced fears it will eventually become powerful enough to undermine Russia’s nuclear deterrent. Moscow has proposed running the missile shield jointly with NATO, but the alliance has rejected that proposal.

Makarov’s statement on Thursday doesn’t seem to imply an immediate threat, but aims to put extra pressure on Washington to agree to Russia’s demands.

The “gay” folks just as much right to refuse business to Christians as the Christians do to refuse to the Gays.  Purely Constitutional.  The fact the sate is apparently going to force the issue would be enough for me to move out of that state.

A Lexington, KY t-shirt company is under investigation by the city’s Human Rights Commission after they refused to print t-shirts for a local gay rights organization.

The owner of “Hands On Originals,” a well-known t-shirt company in the region, declined to print the shirts for the city’s Gay and Lesbian Services Organization (GLSO) because it would conflict with their Christian convictions.

The privately owned company is now accused of violating Lexington’s Fairness Act – which protects people and organizations from discrimination based on sexual orientation or gender identity.

The attacks are out of line, said Jim Campbell, an attorney with Alliance Defense Fund, the organization representing “Hands On Originals.”

“No business owner should be forced to violate his conscience simply because someone demands it,” he said. “The Constitution absolutely supports the rights of business owners to decline a request to support a message that conflicts with their deeply held convictions.”

Raymond Sexton, the executive director of the Human Rights Commission told Fox News that “Hands On Originals” will be “required by law to participate in the investigation.”

“We have subpoena power and have the backing of the law,” he said. “We are a law enforcement agency and people have to comply.”

Should the company be found guilty of discriminating against the homosexuals Sexton said they could be subjected to fines.

“Hands On Originals” has faced a barrage of attacks since the accusations were made public. More than 2,000 people have joined a boycott movement on Facebook. Another group is trying to buy the company’s mortgage so they can be evicted.

The focus folks is in one place and one place only — was the use of force justified. 

That’s it.

The facts as we currently know them support that Zimmerman was attacked from behind, was flat on his back, was assaulted from the top and not free to escape. That’s consistent with both witness reports and physical evidence as noted in the above report.  I note that both former Governor Bush and the author of the “Stand Your Ground” law have both said that the Castle Doctrine is inapplicable to this circumstance and they’re correct; an altercation in which you are physically prevented from leaving by someone sitting on you after knocking you to the ground removes all consideration of that law from the decision process and the legal evaluation.

That there are contrary witness reports is not surprising; if you’ve ever looked at reports from a particular “simple” incident such as a traffic accident there are frequently very different things reported by the various witnesses.  The job of the investigating agency is to filter this information by both assessing the credibility of the witnesses and the physical evidence.  That which is contrary to the physical evidence can’t have happened, no matter how many people claim it did.  A couple of years ago I was a witness to a horrific traffic accident that was described very differently than what happened by one of the drivers and a couple of other witnesses — unfortunately for them the physical evidence (skid marks on the roadway and point of impact) were inconsistent with what they claimed they saw, but entirely-consistent with what I saw and reported.  The young driver (who they tried to pin the accident on) was in fact not at fault as the other vehicle emerged from between two trucks in a line and entered his lane outside of an intersection leaving him less than a car length to react — it was literally impossible for him to have avoided the collision as the distance covered by a vehicle during the best-case human reaction time exceeded the distance between the vehicles at the lawful speed for that section of road.  I suspect my testimony, which I was happy to provide in written form, saved him from at least a chargeable accident and perhaps a suspended or revoked license.

In this case Zimmerman had a documented physical injury on the back of his head that was bleeding when he was “cuffed and stuffed”, along with bleeding from his nose.  It was also apparent from physical evidence that he was on his back on wet ground (grass stains and water on the BACK of his shirt.)  Reports are that Martin was shot in the front of his body, not in the back, so he was facing the weapon when it discharged.

These are physical facts that to the best of my knowledge are not in controversy.

If Zimmerman was the aggressor how did he get injured on the back of his head with sufficient force to cause bleeding?  Further, if he was on top of Martin how did Zimmerman’s shirt get grass stains on the back?  Such claims are inconsistent with the physical evidence.

The media has refused to present a reasonably-recent picture of Martin.  There are multiple ones floating around on the Internet; one I’ve seen is of highly-questionable provenance and thus I discount it’s probative value until and unless it is validated as real.  But there’s likely a reason that all of the pictures presented thus far are four years or more old and show Martin when he was 13 — and not now, when he was 17.  This sort of blatant “in your face” distortion ought to be ringing everyone’s alarm bells at high volume — that it isn’t is very disturbing.

This is going to work well.  Because you want to have things exactly your way however it is and don’t get it you are going to cause the cancellation of various after school activities that specifically help students to expand their horizons and help them move forward in life. That’s interesting that in one hand the unions says we want appreciation but then they are going to take an action that while legal goes against the very thing they say they don’t want to do.  Folks wonder why i don’t like modern unions…it’s right here in plain view in our county.  The commissioners next time need to let the teachers strike then use replacements until the teachers themselves start loosing their own incomes(strike funds last maybe two weeks).  The teachers will realize they union isn’t helping them at all…at least the smart ones will.

 

Frederick County teachers are upset with budget decisions made by the Board of Education, and beginning March 30 will “work to the contract,” according to Frederick County Teachers Association president Gary Brennan.Theyll put in 100 percent during their seven-and-a-half hour workday to teach and grade papers, but theyll take a duty-free lunch, as the contract stipulates, he said.Once their workday is up, teachers will go home to their families, leaving any papers left to be graded at school, since they are supposed to have time during the school day for grading, according to Brennan.Brennan said the action centers around budget decisions made at the Feb. 22 board meeting where the board decided to put in a request for extra funding from county commissioners while balancing the budget by slashing the proposed salary resource pool for employee raises in half.The budget also includes possible furlough days dependent upon negotiations and the reversal of a 1.5 percent salary adjustment in fiscal 2012, which was a one-time stipend.”We feel that both the BoE and the county commissioners have not shown the commitment to public education that employees have,” Brennan said.The decision to implement a work-to-rule action was made unanimously March 8 by the unions representative assembly, which includes members from every school, according to Brennan.The teachers association is asking all of its nearly 2,800 members to participate in the upcoming work-to-rule. Teachers are going to work to the spirit and letter of their contract, Brennan said.The expectation during the action is that teachers will perform up to contract expectations, but it may take longer to assess student work and to get back to parents, as teachers will have to prioritize their core functions, he said.”What they really want from the community and the elected officials is appreciation,” he said.Ballenger Creek Elementary School will cancel its annual talent show because teachers volunteered their time for the event and were not compensated, according to a letter sent home to parents Friday.Theres probably a laundry list of similar situations in the county where after-school programs will need to be canceled, Brennan said.He said this action is “horribly negative,” but teachers have come to be taken for granted.”Its not a positive thing, but what I hope comes from it is a recognition of how much educators in this county do to see children succeed,” he said.

Currently in the Maryland Senate there is debate over the same-sex marriage bill that was recently passed by the Maryland House of Delegates. It is likely to pass and then be signed into law by Maryland Governor Martin O’Malley (D).

 

The issue of legalizing same-sex marriage has gained tremendous momentum in the United States over the last 10 years. The acceptance of more open discussion of homosexuality has – in large part – been due to the rapid change in an ever-evolving media culture that allows for freer expression and celebrating life outside the norms of society.

 

Those who don’t embrace the homosexual lifestyle, but accept or tolerate it, are a majority of our society. The societal norm for couples is and will always be defined as a woman and a man. For those who won’t – or don’t want to – accept the gay lifestyle as the norm do so because they believe homosexuality to be unnatural or abhorrent.

 

The left, which flexes its might through bullying tactics, treats those with traditional values as “out of step” with society. They deride these same people as “homophobic” – a term, if defined properly, would mean fear of the same – or afraid of homosexuality. Those who don’t tolerate homosexuality are not afraid of anything; they either have religious convictions or personal belief that it is an immoral act. Because they hold these beliefs does not make them bigots.

 

In the United States there are estimated to be well over 11 million illegal immigrants – this number would be much higher if it weren’t for a faltering economy. Attempts at curbing the tide of immigration and even deporting those here illegally comes at a price for those supporting deportation. The left, which benefits by the presence of illegal immigrants, will frequently and unhesitatingly intimidate those who disagree with them.

 

They attempt to intimidate opponents by claiming racism. But aren’t all men and women from the same race – the human race?

This guy leads other Marines to a massacre and gets no jail time…while this soldier killed a known insurgent in self-defense and get sentenced to life?!?!?  I’m former military and the military “justice” system is nothing like civil system.  The fact that soldiers are being ramrodded for purely political reasons is disgusting in the extreme.

 

After agreeing to a plea bargain on Monday, Staff Sgt. Frank Wuterich expected a sentence of 90 days in jail for slaughtering civilians during a 2005 massacre in Iraq. On Tuesday that term was nixed, and now the confessed killer will only be demoted.

A spokesman for the US Marine Corps base near San Diego, California told the media on Monday that “By pleading guilty to this charge, Staff Sergeant Wuterich has accepted responsibility for his actions.” Those actions — a starring role in a brutal massacre that left 24 people dead in Haditha, Iraq back in 2005 — led to eight Marines being faced with a multitude of charges over the last six-plus years. Wuterich was the last of the eight men to be brought to trial, but on Monday he accepted a plea bargain in lieu of continuing with his trial that involved, among other charges, nine counts of manslaughter against him.

The terms of the plea bargain, as reported Monday, were believed to include three months of containment in a military prison, the forfeiture of two-thirds of his pay and a rank demotion. On Tuesday, however, the harshest penalty for the staff sergeant was revoked and now Wuterich will see no jail time for his role in the murders.

On November 19, 2005, Wuterich led a squad of US Marines into two separate homes in Haditha, Iraq outside of Baghdad. The men opened fire on civilians, killing two dozen men, women and children, including an elderly man confined to a wheelchair. He would later admit to instructing his peers to “shoot first and ask questions later” and insisted that, despite no weapons ever being recovered from the Iraqi homes, that the American fighters were under assault.

On Tuesday, Wuterich admitted that his name will always be associated with that of “a cold-blooded baby-killer” and “an out of control monster,” but appeared emotionless when his scanty sentence was finally handed down, reports Reuters. He accepted guilt for leading the fighters through the massacre, but said that “the intent wasn’t that they should shoot civilians. It was that they would not hesitate in the face of the enemy.”

“The truth is, I don’t believe anyone in my squad … behaved in any way that was dishonorable or contrary to the highest ideals that we all live by as Marines,” added Wuterich.

At a time of difficult trade offs and decisions.  We are all integral parts in our overall progress.  There are not easy decisions.  We must depend on the truth in our own hearts.  There is something that stirs with each of us.  When we talk to a family who has a job, who has saved their home from foreclosure, it is the same feeling we all saw in the eyes of native children.  These children were native Marylanders and recognized for the first time in 380 years.  There are many who will ask why the long time?

May the choices we make for human dignity, for jobs, for the generations that count on ours for a better future.

This state was founded on freedom of choice and conscience.  Children of gay couples should have the same rights for marriage as the children for traditional marriage.  Maryland will not force religious organizations to marry couples that are against their beliefs.  It is time to pass civil marriage equal rights under the law.

We are going to be submitting 700 pages of rules and regulations for reform or removal.  This government has settled with excelon.  They will build a new gas fired power plant.  They will create 6k new jobs.  Maryland is looking at more green projects.  Large scale housing septic developments cause more than 6 times the pollution into the bay than sewage.  The septic task force has presented a plan that will help solve this issue.

This is a jobs budget.  52k jobs for modern schools, infrastructure.  We must bear these costs for our state’s future.  This budget invest in 78k teaching jobs, 11k jobs of building real classrooms, 19k record procurement, 7k jobs from venture capital jobs,   Various jobs related to building various infrastructure projects all over the state.  Areas covered are law enforcement, higher education, utility, healthcare, utilities.  These must be balanced with cuts, revenue, and partnerships.  We have relied almost entirely on cuts.  With 84% dedicated to education and public safety,  cuts are nearing the end.  Revenues must be raised.

 

Pensions should be aligned with other states.  Maryland is proposing a 50/50 split for teacher pensions between state and counties. How much less public safety and education are we willing to accept?  Green upgrades have greatly helped the bay.  The flush tax should be reworked to a fee based system based on usage.

Transportation funding needs to be increased.  Our traffic is some of the worst in the nation.  Gasoline is our primary transporation revenue.  Tax is still 20 cents from 1992.  if we settle for 1992 tax rate we will have to settle for 1992 infrastructure.  Best way to fund current costs is to repeal the sales tax exemption at 2% per year.  Nobody is going to do this for us..we must do it.

 

College is more affordable and healthcare is more affordable. Maryland is number 1 in the nation for the 4th year in a row.  Teachers have been the driving force of this performance.  Colleges are graduation 19% more students than last year.  Failing to invest in out future is not a wise choice.

Nothing more important for family security is a job.  State of state is strong on jobs.  Moving into new era of job creation from Bush era recession.  Maryland in the lead by harnessing education, making higher education more affordable, modernizing infrastructure. More Marylanders are working this year than last.  Small Business are also moving to Maryland with the support of various state gov’t programs.  Home foreclosures are down due the state’s hope hotline.  This hotline saved a daycare form foreclosure as an example.  Investing in one stop centers has helped citizens retrain into new fields that has led to new jobs for citizens.

Unemployment is still to high.  Good enough is not the way.  Shortsighted choices have undercapitilized our busineses.  Last year good choices hae allowed maryland to create more jobs at a faster pace than Virginia.  Maryland has a AAA bond rating form all three bond agencies.

 

College is more affordable and healthcare is more affordable.

He thanks God for our people and state beauty and for our armed forces and their and their families sacrifices.

Thanks legislative leaders for their work at all levels.  Thanks law enforcement for lowest crime in 30 years.  Thanks foreign visitors and state cabinet for their attendance and in the case of the cabinet for their good work so far.

Tax Increases, Same-Sex Marriage, “Green Wind Energy”, Shifting Teacher Pensions, Job Creation.

My Facebook thread is going to get busy as well as other outlets that get this feed.  I’m going to post the Governor’s speech.  This is totally my opinion in this feed.

Folks you REALLY need to read the entire article linked to in my last post.  HOwever for those who don’t follow links here’s the full story from the market Ticker which details the fallacies in the Govt’s story:

 

WASHINGTON – States should ban all driver use of cellphones and other portable electronic devices, except in emergencies, the National Transportation Board said Tuesday.

The board made the recommendation in connection with a deadly highway pileup in Missouri last year. The board said the initial collision in the accident near Gray Summit, Mo., was caused by the inattention of a 19 year-old-pickup driver who sent or received 11 texts in the 11 minutes immediately before the crash.

Ok, so the pickup driver (who was killed) may have been paying attention to his phone instead of the road, and hit a tractor trailer that had slowed down for construction.  That would be a nice narrative and certainly cause for concern if it were true. 

Let’s read carefully and see if it is:

Driver distraction wasn’t the only significant safety problem uncovered by NTSB’s investigation of the Missouri accident. Investigators said they believe the pickup driver was suffering from fatigue that may have eroded his judgment at the time of the accident. He had an average of about five and a half hours of sleep a night in the days leading up to the accident and had had fewer than five hours of sleep the night before the accident, they said.

So they’re not actually sure if he was paying attention to the phone at the time of the incident.  He had engaged in receiving and/or sending (heh wait a second… we’ll deal with that below) texts in the minutes leading up to the wreck, but they admit:

It’s not possible to know from cellphone records if the driver was typing, reaching for the phone or reading a text at the time of the crash, but it’s clear he was manually, cognitively and visually distracted, she (Deborah Hersman) said.

Actually, Ms. Hersman just admitted she doesn’t know exactly why the teen plowed into the tractor.  While the article says that 11 texts were either sent or received in the 11 minutes prior to the crash the direction of the messages is not disclosed nor are their timestamps.  If I send you 11 texts and your phone is in your pocket this pattern would be found in the telco records, but that in no way, without knowing more, evidences whether you pulled and read the texts or whether you sentany of them.  What if all of them were sent 10 minutes before he wrecked?  Ah grasshopper, perhaps the phone was in his pocket and he wasn’t manipulating it at all!  Why doesn’t the NTSB disclose the specifics?  Is it because what the data actually shows doesn’t fit their narrative?

Further Deborah assumes the driver was reading or sending the messages as proximately involved in the crash but being very tired the driver could have nodded off!  That will quite-reliably lead you to ram the guy in front of you, incidentally.  Ever driven while tired?  I have.  If you find yourself in that situation pull off the damn road at the nearest safe place and take a nap!  The life you save is very likely to be your own (and anyone else in the vehicle with you.)

Let’s continue onward here, because this story is about to get very interesting.

Let’s first look at the “justification” for the newly-pontificated NTSB position:

At any given moment last year on America’s streets and highways, nearly 1 in every 100 car drivers was texting, emailing, surfing the Web or otherwise using a handheld electronic device, the safety administration said. And those activities spiked 50 percent over the previous year.

Sounds bad, right?  Keep reading.

The agency takes an annual snapshot of drivers’ behavior behind the wheel by staking out intersections to count people using cellphones and other devices, as well as other distracting behavior.

Now wait a minute.  Staking out intersections eh?  Were the drivers reading a text or something else on their screen doing so while safely stopped at a red light in traffic?  How else could the “stake outs” see with sufficient clarity (time, ability to discern if someone has said device in their hand, is using it, etc) unless the car is stopped?  Isn’t it funny how the “surveillance” claims to be taken in a place and through a form and fashion that would pretty much mandate that the person being looked at was not moving at the time?  Further, how about the guy (like me) who has said phone in a holder and it’s running a navigation program speaking directions (e.g. “turn right in 200 yards”)?  Do I count as an “offender” in this case because my screen is lit?  It sounds like from the above they count someone with a Garmin sitting on the dash as “distracted.”  What if my bluetooth earpiece is in my ear (easily visible) but I’m not actually talking to anyone?  How do you know? And by the way, if I’m stopped at a red light exactly what’s dangerous about looking at a text that was received some time prior when I heard the phone “bing”?  Exactly what am I going to strike while stopped at a traffic signal?  If I’m using my bluetooth earpiece or speakerphone to make or receive a phone call (stopped at a light or not) how does that conversation differ from one with the person in the passenger seat of the car?  Are we going to be told that all passenger seating positions must be walled off from the driver — and that no radio or navigation assistance may be fitted in the vehicle either?

Why do I smell intentional fraud upon the public in this so-called “study”?

Here’s why — back to the accident details:

The pickup, traveling at 55 mph, collided into the back of a tractor truck that had slowed for highway construction. The pickup was rear-ended by a school bus that overrode the smaller vehicle. A second school bus rammed into the back of the first bus.

So let me guess — the school bus drivers were using their cellphones too, right?  That would explain why both bus drivers didn’t notice that the truck in front had slowed down and they both got involved in a multi-vehicle pile-up.  It would also provide reasonable justification for the NTSB position.

There’s only one problem – that’s not what happened, and now we get to the meat of the NTSB scam and fraud upon the public by our so-called “civil servants”:

Investigators also found significant problems with the brakes of both school buses involved in the accident. A third school bus sent to a hospital after the accident to pick up students crashed in the hospital parking lot when that bus’ brakes failed.

Wait a second!

Our intrepid 19 year old dies because he’s stupid.  Whether that was due to driving while tired or texting we will never know for sure, but it doesn’t matter.  Murphy is a bastard and the kid’s ticket got punched.

However, by taking a material amount of the impact himself he may have actually saved lives as it appears both of the school buses behind him had non-working brakes!  And the presence or absence of a cellphone by the 19 year old, no matter whether it was in his hand or pocket, has nothing to do with that!

First rule of driving: You’re always responsible for your own situational awareness so that you can either stop or evade irrespective of what the vehicle in front of you does (or doesn’t) do.

If you hit someone from behind it is almost always legally your fault as you’re required to maintain that aforementioned situational awareness.

Now remember folks that a School Bus has a much higher driving position and thus higher sight line than a pickup truck.  As such the driver of the School Bus had to have been able to see the tractor rig slow in front of him as he could see over the pickup and in any event the tractor is ~10+ feet tall!

In short it is rather obvious that the school bus hit the pileup of the tractor and pickup not because the pickup struck the tractor but because the school bus driver was either not paying attention or was unable to stop, and the second bus hit him because the second bus could not stop either!  And why couldn’t they stop?

The NTSB says both buses involved in the collision had significant problems with their brakes!

Worse, a third bus from the same school district sent to pick up the students after the wreck crashed in the hospital parking lot when its brakes failed too!

What the hell did this accident and all the kids that got hurt, other than the 19 year old in the pickup, have to do with texting on a cellphone?

NOTHING!

Had the 19 year old not been distracted (or half-asleep, which seems at least as likely) he almost-certainly would have slowed and been hit from behind by the first and second bus anyway.

This is a massive scam folks.

You have a kid here who’s dead and can’t defend himself against the libel that he was somehow responsible for the injuries other than his own.  Whether he was distracted or fell asleep behind the wheel he paid for his offense with his life.  We don’t even know with any reasonable degree of certainty that he was actually looking at his phone in the first place. You can bet, incidentally, that if the NTSB had proof that he had been sending those messages or that he was actually reading them at the time of the wreck they would have said so.

What’s obvious, however, by the NTSB’s own statement, is that the injuries would have ended with the teen driver of the pickup but for not one but two separate school buses operating on the roads without properly-working brakes and/or attentive drivers and the third one sent to the hospital to retrieve the victims had defective brakes as well.  The risk of further injury to the kids was avoided only due to the bare luck of that third bus crashing in the hospital parking lot first!

So what do we have here?  Slander of this kid’s good name without evidence.  An attempted deflection of the actual cause of the injuries to the children on the buses through the desperate search for something, anything to blame those injuries on that doesn’t rest upon three poorly-maintained school buses without properly-working brakes that were being operated on the public highways — something the NTSB and DOT is directly responsible for.  And finally, in the best of Goebbels tradition by our jackbooted Nazi Government we have an outrageous overreach and attempt to advocate new legislation for the purpose of harassing motorists who are doing nothing wrong based on falsified evidence, slander and lies.

Of course it turns out that texting wasn’t the primary..or even the reason at all for the crash that is now being used by the feds to try to invade our lives even more. Sure texting while driving is dangerous..there’s no need for the Feds to stop into this. Read this story about who owns you for some background.  Right now just waling down the street you are probably going to break some law and you don’t know it.  Guess where that type of life exists or existed?  China, USSR, North Korea.  We don’t yell about it because it’s hidden…at least those other countries openly show their dictatorial ways…:(

Congress is supposed to work in public. That requirement is in the Constitution. It is there because the folks who wrote the Constitution had suffered long and hard under the British Privy Council, a secret group that advised the king and ran his government. 

We know from the now-defunct Super Committee, and other times when Congress has locked its doors, that government loves secrecy and hates transparency. Transparency forces the government to answer to us. Secrecy lets it steal our liberty and our property behind our backs.

Last week, while our minds were on family and turkey and football, the Senate Armed Services Committee decided to meet in secret. So, behind closed doors, it drafted an amendment to a bill appropriating money for the Pentagon. The amendment would permit the president to use the military for law enforcement purposes in the United States. This, of course, would present a radical departure from any use to which the military has been put in the memory of any Americans now living.

The last time the federal government regularly used the military for domestic law enforcement was at the end of Reconstruction in the South, in 1876. In fact, the deal to end Reconstruction resulted in the enactment of federal laws forbidding the domestic use of American military for law enforcement purposes. This has been our law, our custom and our set of values to which every president has adhered for 135 years.

It is not for directing traffic that this legislation would authorize the president to use the military. Essentially, this legislation would enable the president to divert from the criminal justice system, and thus to divert from the protections of the Constitution, any person he pleases. And that person, under this terrifying bill, would have no recourse to a judge to require the president either to file charges against him or to set him free.

State mandated.  Sure they got tons in grants BUT they still have 5 million in debt which is crushing for a small municipality like Emmitsburg.  Keep in mind Emmitsburg is nearly half the size of Brunswick just to get an idea of the size and how crushing this debt load is.  400k a year in costs(that will also only go up) are huge for this community and it is only going to get worse.

 

Commissioners voted this past week to increase rates to fund construction of a new state-mandated wastewater treatment plant. The new plant comes with a $20 million price tag, and the town has been awarded $14.5 million in federal and state grants toward the cost. The town proposes to fund the remaining cost with a $5.5 million loan from the U.S. Department of Agriculture, necessitating quarterly payments of $51,000.On top of the loan payment, the new plant will cost the town $48,000 per quarter to operate, bringing the quarterly tab to nearly $100,000.

It is not terrorism to employ lethal violence against an invading and occupying army, nor is it a crime to express support for armed self-defense — or even to call for the violent overthrow of the U.S. government (or do I repeat myself).  

The administration asserted – without providing evidence – that Awlaki had an “operational” role in planning terrorist attacks against U.S. citizens. If evidence supporting that charge existed, the administration had the unconditional constitutional duty to indict Awlaki and put him on trial. 

Intelligence officials knew Awlaki’s location. The government of Yemen, which is headed by a pliant thug named Ali Abdullah Saleh, is a wholly owned subsidiary of Washington and would have eagerly cooperated in an effort to track down and extradite Awlaki. But this would not have validated the claim – made by the Bush administration, and embraced by its successor – that the President of the United States isn’t bound by the Constitution, but rather is the Living Constitution.

As a way to solve the national debt crisis, North Carolina Democratic Gov. Beverly Perdue recommends suspending congressional elections for the next couple of years.

“I think we ought to suspend, perhaps, elections for Congress for two years and just tell them we won’t hold it against them, whatever decisions they make, to just let them help this country recover,” Perdue said at a rotary club event in Cary, North Carolina, according to the Raleigh News & Observer. “I really hope that someone can agree with me on that.”

Let me simply observe that such a “proposal”, if said other than in jest, is an open declaration by an elected official to literally seize power and refuse to cede either office or power to the will of the people.

Should such an act be contemplated, say much less recommended or acted upon, we no longer live in a Representative Republic and the remedies called for in The Declaration of Independence are the only ones remaining for any and all who intend to be a free people living in a nation that operates on the principles of a Representative Republic.

We have not lived in a truly representative Republic for a while as the gov’t in all of its forms have grown substantially in the past decades due to constant inaction by the citizens of this country.  This inaction includes either not voting at all or continuing to vote within the rigged and corrupted two party system we have now.  If no candidate on the available slate is representative of this country it is the duty of the citizenry to vote them out and vote in somebody else.  There is nothing in the Constitution that requires the citizenry to vote form a choice of two candidates.  It is time for the citizenry of this country to get out of the mentality that we are owed gov’t welfare and it is time to take our country back.  Americans right now we face a choice..we either take our country back now through the voting box in November…otherwise the only way we will get it back is the same way this country was formed..a war of Independence which will be bloodier than ever..due to the fact it will be a modern civil war on Independence.  I fear the American citizenry may not be brave enough for the peaceful path much less the non peaceful path.

A gentleman came up for public comment and said they Keys has previously abused the internal maintenance section of the previous contract.  Once the final contract that was passed(it was amended slightly before the vote) is posted online I’m going to read it and see about that.  Then it will be interesting to see if any such abuse occurs.  I am not saying or intimating it did or will.  The amount of accusations being thrown around is quite intense.  the gentleman also told Alderwoman Aloi he thought she should take this Keys contract negotiation to the State Ethics Board because in his eyes he has seen some unethical things happen in that room before and this keys negotiation was another one of those things. It appears the saga may not be over yet.

Alderwoman Aloi is now trying to rescind the approval of the Keys vote due to “a procedural error” on the Mayor’s part.  Motion made to rescind vote seconded.  Young with the second.  Aloi’s stated purpose is to “gain a 5-0 Vote”.  Aloi and Young voted yeah..all others nay.  Motion failed.

Bank of America is going bye bye…and guess who is the executioner?  AIG.  This time AIG isn’t the purveyor of bad assets they are trying to recover bad assets from Bank of America.  Combine this with one of BAC biggest pumpers has dumped them and with BAC’s stock now directly tied to it’s cash reserves BAC is toast.  Remember the disaster TARP 1 was?  The US Gov’t is going to try to do a TARP 2. This WILL IMO lead to a further downgrade by S&P and Moody’s and Fitch may not be able to stand with the US Gov’t against S&P due to the enormous amount of additional debt this will INSTANTLY put the gov’t under.   Despite this Obama and CONgress will try to thumb its nose at the credit agencies and try to keep this huge zombie bank lumbering around mindlessly under the lie of too big to fail.

If you want things to improve in this country in terms of the federal gov’t WE the people need to quit voting these idiots back into office.

 

Let’s start with who’s fault it is not: S&P.

To recap:

S&P warned early in the year that there was a risk of a downgrade.

S&P, when the debate was entered in May, said that they needed to see $4 trillion in actual deficit reduction and that this was a “down payment” on the problem, not the entire solution (they’re right, incidentally.)

S&P then re-iterated the warning when the debate got contentious.

That’s (at least) three separate warnings that were intentionally ignored.  S&P was not ambiguous nor did they blindside anyone.  They told the government exactly what they needed to see and when in order to avoid the downgrade.  They’re blameless.

So who’s to blame?

CONgress, for it’s willing refusal to either clearly state that it didn’t care if the downgrade happened or complying with S&Ps demands. Pick one.  When you have a firm saying “do X or we do Y”, and that’s a legal act, you either do X or you expect Y.  It is the height of arrogance to try to shine someone on like this – yet Congress did – on both sides of the Aisle.

President Obama, for his belief that he could simply bully an independent business into not doing a lawful thing.  Again, he is a President, not a King.  Go back to Chicago Obama where you belong, and where “kneecap politics” are the way of the world.  Illinois deserves you.

We the people, for our refusal to accept that we cannot have services from our government we refuse to pay for in the present tense.  This is a fact, whether we like it or not.

To the “Tea Party” that was crowing about how they were “successful”, how does that success taste?  Half of your members in fact defected when it came time to vote, and despite the crows of “success” (which was really nothing more than glee over “beating the Democrats desire to increase taxes”) the bad outcome that you claimed to be trying to avoid happened.  Now what? 

To the Democrats who said this was a “good bill” or even one “we can support”: How does abject failure taste?  Your refusal to admit that you cannot spend more than you take in on a perpetual basis and your incessant demands to spend more and more without any plan to pay for it, despite screeches of “tax the rich” and “fair shares” has gone nowhere. 

To the “mainstream” Republicans who said this was “the best we could do” or even “a good bill”: How are you feeling this morning?  Got out of town in seconds after that vote did ‘ya?  Well gee, that worked out real well eh?  Now what? 

Some more facts – and you’re not going to like any of them:

Within hours of the passage of the bill more than half of the authorized increase in the debt ceiling (the first tranch) was blown and gone as Geithner unwound all the screwball theft games he had played for the previous two months.  More than $200 billion instantly vanished.  The scale and price of his deception was instantly laid bare upon the table, as was our fiscal trajectory, since June is one of the heavy tax receipt months (estimated taxes.)

In calendar year 2007 GDP was $14.3 trillion, more or less.  The actual borrowing increase was $548 billion.  The Federal budget was $2.73 trillion.  To balance our fiscal house we would have had to cut 20% of the Federal government – in 2007.

In the last year GDP was $14.8 trillion, more or less.  The actual borrowing increase was $1,700 billion.  The Federal budget (which was never actually passed and signed, a rank violation of Constitutional requirements) was $3.8 trillion.  To balance our fiscal house we would have had to cut 45% of the Federal government – more than double the 2007 figure.

To bring the economy into balance debt must not grow faster than GDP.  In a time when GDP is shrinking debt must shrink faster, not grow faster.  This is basic exponential mathematics.  15 minutes with Excel will prove this to anyone’s satisfaction.  This has been the foundation of my perspective on the economy and our errors since I started pontificating in public on it in the 1990s while running MCSNet, and has been the foundation of The Ticker as well.  Twice in the last month or so I have posted links to Google spreadsheets for those too lazy to do it themselves, making it even easier to visualize what I’ve been talking about.  Anyone arguing otherwise must be able to demonstrate why the laws of mathematics do not apply and prove they are correct, and if they’re unable to they must be ejected from the debate on the path we take as a nation.

As a former military member myself I can tell you one thing.  When you sign into the military there is no guarantee of a fair trial.  I personally witnessed several folks get railroaded out of the military because they did not pull the “line”.  If what this defense attorney says is true it is not surprising.  Folks not only write clemency letters but get your congress critter involved.  Only pressure form the masses and congress is going to get the POTUS to override atrocities like this that are being routinely performed against our military personnel.  Due to the fact that military actions both in Afghanistan and Iraq are illegal it’s time to bring our military members home.  They are to defend our country not to be used as occupation forces in a non-US strategic country for “nation” building.

 

The witnesses against SGT Miller were a soldier who originally supported SGT Miller’s version of events, but he changed his story when he was threatened with being named an accessory and being placed on legal hold so he could not de-mobilize.  The other witness was an Afghan translator who was promised US Citizenship in exchange for his testimony.  He was brought to the US in January and has been living on Fort Campbell in a base hotel at $630 per month with a dedicated van to take him wherever he wants to go, and has been fed at taxpayer expense.  Basically, the two witnesses had every incentive to testify the way the Government wanted them to — consistent with guilt rather than SGT Miller’s claim of innocence.  SGT Miller cooperated in every way from the date of the shooting, but his command lacked the moral courage to stand behind him.

An online petition has already gathered 650,000 signatures calling for a new law – “Caylee’s Law” – that would make it a criminal offense to fail to report one’s own missing or dead child to law enforcement within 24 hours (as Anthony failed to do.)

State legislators around the country are eager to introduce the laws. In the version of “Caylee’s Law” under consideration in Florida’s legislature, parents would be guilty of a felony even if their child was later found unharmed. In the Kentucky version, parents would face between one and five years in jail.

Laws passed when emotions are high tend to be poorly thought-out. As law blogger Josh Blackman points out:

If a parent actually killed her daughter, do you think she would tell the police so as not to violate some random federal statute?

And the potential unintended consequences are endless. What if the child has a history of getting mad and running away for a day? Or a week? What if the kid sleeps over at a friend’s place?

Salon.com points out that laws named after victims and passed in an emotionally charged atmosphere have a bad track record. Almost all the laws that go after sex offenders – “Megan’s Law”, the “Adam Walsh Act”, “Dru’s Law”, and “Jessica’s Law” – are named after victims. Yet as I’ve reported, those laws are responsible for locking up and stigmatizing innocent kids, like sixteen year olds who have consensual sex with a peer.

The government criminalizes too many things. Murdering your child is already against the law. So is lying to the police. We don’t need more laws.

If you are wondering about the subsequent releases after his death…that’s not hard to manufacture with modern technology and the large amount of audio and video footage we have on him.

Over a four-month period last year, a military cell devoted to what is known as “information operations” at Camp Eggers in Kabul was repeatedly pressured to target visiting senators and other VIPs who met with Caldwell. When the unit resisted the order, arguing that it violated U.S. laws prohibiting the use of propaganda against American citizens, it was subjected to a campaign of retaliation.

“My job in psy-ops is to play with people’s heads, to get the enemy to behave the way we want them to behave,” says Lt. Colonel Michael Holmes, the leader of the IO unit, who received an official reprimand after bucking orders. “I’m prohibited from doing that to our own people. When you ask me to try to use these skills on senators and congressman, you’re crossing a line.”

He doesn’t get why though..at least not publicly.  As long as we are over there all the muslims have a common enemy.  All we have to do is leave..and they will do what they do best..fight each other.  The middle east kept itself well in check before we arrived.  They’ll return to fighting each other once we leave.

Iran’s supreme leader Ayatollah Ali Khamenei on Sunday called on Muslims to “remove” the US from the Islamic world.

“The main problem in the Muslim world is the presence of the United States. It is the biggest problem. We need to address that,” he told a gathering of Shiite and Sunni scholars in Tehran for an international conference on Islam.

“It is necessary to remove the US from the Islamic world,” the all-powerful cleric and Islamic republic’s commander-in-chief said, adding that the country’s arch-foe was currently weak.

Khamenei urged Muslims worldwide to preserve the “people’s movement in Egypt,” saying it was the duty of both the people and dignitaries of Arab nations and the entire Islamic community.
